The lawsuit was filed by Devin Kim, a former member of xAI’s post-training team and current president of the Center for AI Safety. Interestingly, the lawsuit focuses less on Elon Musk personally and more on internal leadership decisions. Court filings specifically name former xAI co-founder Jimmy Ba, alleging that he opposed stronger safety protocols and prioritized rapid AI development over risk mitigation. According to the complaint, company leadership emphasized competitive pressure in the AI race while dismissing concerns about long-term safety implications.

The legal battle arrives at a sensitive time for xAI. The company has become one of the fastest-growing players in artificial intelligence and recently secured massive funding rounds while expanding Grok’s capabilities across multiple platforms. At the same time, regulators, researchers, and lawmakers worldwide are increasingly questioning how AI companies balance innovation with public safety.

Kim is seeking financial damages as well as a court ruling that xAI and affiliated entities violated California labor protections for employees who report unsafe or potentially unlawful practices.
