Nvidia employee charged in Taiwan over alleged illegal AI chip exports to China
A Taiwan-based Nvidia employee has been charged along with eight other individuals in connection with an alleged scheme to illegally export advanced artificial intelligence servers containing Nvidia chips to Chinese customers. The case is being described as the first known major crackdown in Taiwan involving the black-market trade of advanced AI computing equipment amid strict U.S. restrictions on semiconductor exports to China.

Taiwan’s Keelung District Prosecutors’ Office said the group was involved in arranging the shipment of 130 high-end AI servers equipped with Nvidia’s advanced chips. Authorities said 74 of the servers were successfully sent to China, while Taiwan customs officials intercepted the remaining 56 before they could leave the country.

The Nvidia employee, identified by the surname Zhang, is accused of helping organize the shipments and moving servers containing high-end B300 chips through Japan and Indonesia in an effort to bypass international export restrictions. Prosecutors allege that the group worked together to conceal the final destination of the equipment and generate significant profits from the transactions.

The investigation also involves employees of server manufacturer Super Micro Computer, a Taiwanese distributor and other intermediaries. Super Micro Computer said it was cooperating with Taiwanese authorities and emphasized that the company itself was not a target of the investigation and had not been accused of wrongdoing.

The case highlights the growing difficulties surrounding the international trade of advanced AI hardware. The United States has introduced strict export controls on high-performance semiconductors and artificial intelligence computing technology destined for China because of concerns over national security and potential military applications.

These restrictions have forced Nvidia to modify the products it can legally sell in the Chinese market. At the same time, Chinese companies have been encouraged to reduce their dependence on American semiconductor technology and develop domestic alternatives.

The restrictions have also created strong incentives for illegal trading networks. Advanced AI chips and servers can command significantly higher prices on unofficial markets, with some equipment reportedly selling for two or three times its original value.

According to prosecutors, Zhang played an active role in securing an allocation of servers and participated in an inspection of the data center where the equipment was supposedly intended to be installed. Authorities allege that he knew the stated buyer did not have enough financial resources to purchase the equipment and that the money used for the transaction originated from a Chinese company.

Prosecutors have requested the maximum five-year prison sentence for Zhang and three other defendants. They have recommended shorter sentences for the remaining five individuals charged in the case.

Nvidia said its employees are expected to follow all applicable laws and export regulations when working with customers. The company also said it would cooperate with Taiwanese authorities as they investigate the allegations.

Zhang was initially detained in July. Nvidia said at the time that it primarily sells its products through established partners, including original equipment manufacturers, which help ensure that transactions comply with U.S. export control requirements.

The investigation demonstrates how increasingly valuable advanced AI hardware has become as governments compete over semiconductor technology and artificial intelligence capabilities. It also highlights the challenges faced by chipmakers and authorities in preventing restricted technology from reaching prohibited markets through complex international supply chains.
